VIRGINIA BEACH, Va. (WVEC) -- One of the men accused of using a stolen credit card to pay for their restaurant bill has eight left behind bars.

A judge sentenced Roget Smith to six years on Monday, but with five years, four months suspended.

Smith was one of three men arrested back in April for attempting to use a stolen credit card number to pay for their meal at Ruth's Chris Restaurant in Virginia Beach.

Restaurant staff alerted police after receiving a call from the card owner, saying she had received an alert from her credit card company.

Police arrived just in time to find the suspects leaving the restaurant. Officers found other fraudulent credit cards in their possession.
