NORFOLK, Va. (WVEC) -- A federal appeals court ruled in favor of Trinity Industries, saying the company did not defraud the government.
A whistle blower claimed Trinity committed fraud when it failed to disclose a design change to the ET-Plus guardrail end terminal.
Lower courts ruled Trinity should pay millions of dollars in damages.
On Friday, a federal appeals court reversed the district court's decision.
The opinion reads, "When the government, at appropriate levels, repeatedly concludes that it has not been defrauded it is not forgiving a found fraud, rather it is concluding that there was no fraud at all."
