Virginia Beach to discuss filling empty council seat

A three-judge panel ruled David Nygaard wasn't eligible to represent the Beach District because he didn't really live there.

VIRGINIA BEACH, Va. — Virginia Beach City Council is expected to discuss plans to fill the empty council seat once held by David Nygaard.

Nygaard served for about three months on the Beach District council seat, until earlier this month, when a three-judge panel ruled he wasn't eligible for the seat because they believed he lived in the Lynnhaven District and had a 20th Street duplex just so he could run for Beach council seat.

They based their decision on three things: witnesses, exhibits, and applicable law.

So, the city council is left to figure out who will temporarily fill the city council seat until a special election can be held this upcoming November. City council members are hoping to find a solution after getting a briefing on the appointment process on Tuesday.

Nygaard already says he plans to run again.
