Man arrested for shooting crowbar-wielding attacker at McDonald's

A man is facing charges after he allegedly shot another man who was wielding a crowbar inside a Norfolk McDonald's on Wednesday morning.

NORFOLK, Va. (WVEC) -- A man is facing charges after he allegedly shot another man who was wielding a crowbar inside a Norfolk McDonald's on Wednesday morning.

Authorities say the shooting happened shortly after 9 a.m. inside the McDonald's at 2328 E. Princess Anne Road.

The gunshot victim, a 38-year-old-man, was taken to Sentara Norfolk General Hospital for non-life threatening injuries.

Police detained 53-year-old Stephan Hayes at the scene. Witnesses say the shooting victim had walked into the restaurant and attempted to attack Hayes with a crowbar. 

Hayes was armed a gun and reportedly shot the man in the leg. Other McDonald's customers described the man with the crowbar as being disoriented and sweating when he walked into the restaurant.

Police say both men knew each other.

On Wednesday afternoon, Hayes was formally charged with malicious wounding and use of a firearm. He is currently being held in the Norfolk City Jail.

Hayes' brother told 13News Now the charges were uncalled for because Hayes was acting in self-defense.

"My brother feared for his life so he took matters into his own hands. He gave the man his warnings. He gave him the opportunity to walk away. They told my brother that he should have walked away. I don't get that-- I don't get that part. I don't understand what's going on," he said. 

There's no word at this time if the man with the crowbar will face any charges.

"We take the safety of our employees and customers very seriously and are working with the proper authorities to assist in their investigation," said JS&J Restaurants Inc, a local McDonald's franchise organization.
