Portsmouth fire captains sue city over overtime

PORTSMOUTH (AP) -- Portsmouth fire captains are challenging their exemption from overtime pay.

More than a dozen former and current fire captains filed a federal lawsuit against the city on Monday seeking unpaid overtime.

The lawsuit says the city has violated the federal Fair Labor Standards Act. It says federal regulations require payment of overtime to anyone whose primary duty is fire protection and emergency response.

The lawsuit seeks compensatory damages for firefighters employed as fire captains within the last three years.

City Attorney George Willson tells The Virginian-Pilot that he hasn't had a chance to review the lawsuit. He says a city review conducted earlier this year concluded that fire captains are properly classified.
