FAIRFAX, VA. (WUSA9) - A Fairfax County bus driver and an aide have been charged after police say an 11-year-old autistic boy was assaulted on a school bus in October.

Edmund Bailey, 35, and James Duffy III, 62, both of Lorton, Va., were each charged with one count of assault and battery.

Police say the first incident was on Oct. 11th and the second incident occurred on Oct. 13th. A staff member intervened during the second incident, according to police.

After a supervisor was notified, surveillance video from the bus was reviewed and warrants were issued last Friday.

Police say both suspects turned themselves in. Bailey has resigned from his position as an aide and police say Duffy is on administrative leave and in the process of being terminated from the county.
