NORFOLK -- Evans Poston, Jr. hit the campaign trail Saturday trying to set the record straight.
He is the Democratic candidate for Commissioner of the Revenue, but you would not know it looking at a new flyer circulating around the city.
The flyer appears almost identical to the real 2013 Voter Guide distributed by the Norfolk Democratic Committee that features pictures of all the Democratic candidates on the ballot in November.
'Same graphics, same pictures, same font, except for my opponent's picture has taken my spot,' said Poston.
The flyer, paid for by an organization called 'Concerned Community Citizens Group,' replaced Poston's picture with one of independent candidate Sherry Battle-Edmonds.
'It's continuing her pattern to deceive and mislead voters of Norfolk,' Poston told 13News Now.
This is the second time this week Battle-Edmonds and the 'Concerned Community Citizens Group' have come under fire for campaign literature.
Another mailer with a grammatical error quotes Republican Congressman Scott Rigell as saying, 'Sherry is a good person and she stands with no fears and no regrets. This is the kind of individuals we need today.'
Jason Miyares, an advisor to Rigell, tells 13News Now the quote is 'completely, utterly false.'
'It's like she made up an endorsement out of thin air,' said Miyares.
We tried reaching Battle-Edmonds at her home and her Norfolk business, but were unable to get a comment.
The Norfolk Democratic Committee says it has contacted the Commonwealth's Attorney's Office to file a complaint.
It also plans to notify the Virginia State Board of Elections.
