10/29 UPDATE: William Burks is scheduled for a preliminary hearing Tuesday afternoon in the York-Poquoson District Court.

YORKTOWN-- Police made an arrest Monday following a shooting that left one man dead in Yorktown.

William E. Burks Jr., 28, has been charged with second degree murder, use of a firearm in the commission of a felony, possession of a firearm by a convicted felon and wearing of body armor while committing a crime.

According to the York County Sheriff's Office, 24-year-old Devon Coates was found shot in the doorway of his home in Yorktown Square and Rivermeade apartments around 12:30 a.m. on June 24.

Neighbors say his wife was in the apartment at the time.

The motive for the shooting is unknown.

Alice Smith, Coates' mother, says her son was a very trusting person and was never in trouble with the law.

'He wasn't a criminal, ' she said. 'He loved everybody.'

Burks is being held in the Virginia Peninsula Regional Jail without bond.
