HAMPTON -- A man who served nearly four years behind bars for a crime he didn't commit is a step closer to clearing his name.

Jonathan Montgomery was imprisoned for the alleged sexual assault of Elizabeth Coast, who later admitted that she made the story up.

The governor gave him a conditional pardon so that he could get out of prison.

Now, his attorneys have filed paperwork, called a petition of for writ of actual innocence.'

Coast was charged with perjury.
