Witness list reveals who will testify in Bigsby murder trial

HAMPTON, Va. — Jury selection is expected to continue Tuesday in the trial of Cory Bigsby, the Hampton man accused of murdering his 4-year-old son, Codi Bigsby, in 2022. 

On Monday, court officials began working through a group of 68 people to select 12 jurors and two alternates. Once the jury is seated, opening statements will begin and the trial, which is planned for March 4-8, will be underway.

Monday's proceedings revealed that Codi's mother is set to be the first witness to testify. Cory's other son, who was 5 years old at the time of the alleged murder, is also expected to testify.

13NewsNow obtained a copy of the “Commonwealth’s Anticipated Witness List” for the trial, which was shared with the defense team. It shows prosecutors plan to call on at least 21 witnesses.

The witness list also appears to include a child forensic investigator, an FBI agent, five employees of the Hampton Roads Regional Jail, and nine employees of the Hampton Police Division.  

The list — which was filed in Circuit Court in October — is not necessarily indicative of who exactly will testify this week, but it offers a good idea of what to expect from the Commonwealth’s case.

Bigsby is accused of killing Codi and concealing his body roughly seven months before filing a missing person report to Hampton Police Division, according to court documents. The boy’s body has never been found.
