Norfolk police officer convicted in fatal accident

A Norfolk police officer involved in a traffic accident that killed a bicyclist has been convicted of reckless driving.

NORFOLK (AP) -- A Norfolk police officer involved in a traffic accident that killed a bicyclist has been convicted of reckless driving.

Officer Derek Folston was convicted Tuesday. Under a plea agreement, prosecutors dropped an involuntary manslaughter charge and a second reckless driving charge.

The charges stem from an accident on July 25, 2010 near I-264 and Campostella Road.

According to court records, Folston's police vehicle hit 34-year-old Donnell Worsley as he rode his bicycle. Worsley had a blood alcohol level twice the legal limit at the time of the crash. Hedied two months later.

Folston was following another officer, Joey Bennett, on the way to a non-emergency call. Both vehicles were going 20mph over the posted speed limit and did not have on lights or sirens.

Officer Joey Bennett, pleaded not guilty last week to reckless driving.

Folston will be sentenced in July. He is currently still on the Norfolk police force.
