16-year-old shot by York County deputy faces felony charges

Sheriff Ron Montgomery said he didn’t learn the teen was released from the hospital until a week after the fact.

YORK COUNTY, Va. — A 16-year-old boy is facing felony charges after a standoff with a York County sheriff's deputy.

On April 14, deputies responded to a call reporting a teen pointing a gun at people at the Clairmont Apartments. 

According to York-Poquoson Sheriff Ron Montgomery, when deputies arrived, the teen barricaded himself inside a car with a gun. After deputies tried to negotiate with the teen, Sheriff Montgomery said he got out of the car and pointed the gun at deputies.

That's when a deputy fired three rounds, hitting the teen twice. The teen went to the hospital with serious injuries.

Sheriff Montgomery told 13News Now that the teen was discharged from the hospital about a week ago; however, he wasn't made aware.

“It was a lack of communication that he was released a week ago," she sheriff said. "We weren’t made aware of it. We didn’t have pending charges for him while he was in the hospital, so that probably could have played into this in some way.”

Sheriff Montgomery said he reached out to the teen's family who cooperated and took him to the Merrimac Detention Facility to be charged. The teen faces the following charges:

  • Assault on a Law Enforcement Officer – Class 6 Felony (One count)
  • Reckless Handling of a Firearm – Class 1 Misdemeanor (One count)
  • Brandishing a Firearm – Class 1 Misdemeanors (Three counts)
  • Juvenile in Possession of a Firearm- Class 1 Misdemeanor (One count)

The teen is now out on bond. Sheriff Montgomery said how the teen got the gun in the first place is still under investigation. 

"We're going to continue the investigation into how he came in possession of the firearm, and we'll explore that. After that, is preparing for court," the sheriff said.

Weeks after the shooting, people who live in the Clairmont Apartments are still coming to grips with what they call a terrifying night.

“I don’t feel as safe as I used to feel," one woman, who wished to remain anonymous, told 13News Now.

The woman lives just feet away from where the shooting happened. She recounted what she remembers from that night.

“My daughter was like, ‘Mom, don’t go near the windows. He just got out of the car and pulled a gun on the police,'" she said.

The woman said she barricaded herself in a bathroom for some time while deputies negotiated with the teen.

“They kept telling him, ‘Get out of the car. Drop the gun. Come on, we want to resolve this peacefully.’ They kept saying that over and over again," she said.

The deputy who fired the shots is still on administrative leave, according to Sheriff Montgomery.
