State says Va. Beach club allowed striptease act

The Virginia ABC will hold a hearing Tuesday about allegations of striptease at Hartz Cafe in March.

VIRGINIA BEACH -- The state is investigation alleged striptease acts at a Va. Beach club.

The owners of Hartz Cafe on Independence Blvd. have a hearing Tuesday to answer the charge.

The state says the business allowed a striptease act, or the like, and entertainers to appear nude or partially nude early on March 7. That violates Virginia law.

At the hearing, state officials could fine the owners, suspend the liquor license or pull the license altogether.

Thehearing is set for9:00 a.m. at the ABC Building on S. Military Highway in Chesapeake.

ABC Charges:

-On March 7, 2010 between 1:01 a.m. and 1:30 a.m., the licensee allowed a striptease acts, or the like, on the licensed premises, in violation of Sections 4.1-325 A.12. and 4.1-226 2. of the Code of Virginia.

-On March 7, 2010 between 1:01 a.m. and 1:30 a.m., the licensee allowed entertainers and other persons connected with the licensed business to appear nude or partially nude upon the licensed premises, in violation of Sections 4.1-325 A.13. and 4.1-226 2. of the Code of Virginia.

A cause exists for which the Board would be entitled to refuse to issue a license, in that the place occupied by the licensee is so located that violations of the ABC Act or the laws of the Commonwealth relating to peace and good order have resulted from issuance of the license and operation thereunder, in violation of Sections 4.1-222 A.2.b., 4.1-225 5. and 4.1-203 of the Code of Virginia.
